IVRY-SUR-LE-LAC TRAILS CLUB

MEMBERSHIP AGREEMENT

 

The undersigned hereby agrees to join Ivry-sur-le-Lac Trails Club (the “Trails Club”) which is sponsored by the Association pour L’Amélioration du Lac Manitou et ses environs (AALM) and to abide by the terms and conditions of its rules and regulations and such obligations as may be imposed upon me in accordance with the terms hereof.

The purpose of the Trails Club is to preserve the trails surrounding the municipality of Ivry-sur-le-Lac for future generations and to provide an enjoyable experience for all members, users and guests. The Trails Club expects all members, users and guests to use the trails with respect, patience, understanding and consideration.

In signing this membership agreement, because some or all of the trails are located on private land, I acknowledge and agree that I will respect the terms of responsible use set forth below. Failure to respect such terms of responsible use may lead to my immediate, non-appealable revocation of my membership from the Trails Club.

The undersigned  also  hereby  agrees with each of the individuals who are identified in Schedule “A” hereto ( the “Landowners”) ( as such Schedule may be amended from time to time, provided that I receive a copy of any amendment to Schedule “A” ) that, in consideration of any such Landowner granting me, in Schedule “A” the right of passage over those trails (the “Trails”) that have been established over the Landowners’ immoveable properties and identified on a trails map prepared by and amended from time to time by the Trails Club with the consent of the relevant Landowners (the “Trails Club Map”), I hereby agree to waive any right of claim that I, or any person that I may utilize such trails at my invitation,  may otherwise have had against any Landowner resulting from any damages, including material, moral or body damages, that I or any such person that may utilize such trails at my invitation may suffer while on the property of any such Landowner, even if such damages occur as a result of any negligence or other fault of such Landowner. I specifically acknowledge and agree that the Landowners have no duty towards me and do not have any obligation to maintain the Trails or to provide access to the Trails or to provide any kind of security whatsoever  for me on the Trails. I also acknowledge that the right is strictly personal unto me in accordance herewith and in no way transferable.

 

I also acknowledge and agree that my use (and the use of any of my invitees) of the Trails is entirely at my or my invitee’s own risk and that the Trails Club, the Association pour L’amélioration du Lac Manitou et ses environs, their respective, directors, officers and members as well as all Landowners are expressly free of any and all liability related to such use by myself and my invitees.

I also understand and agree that because the trails are located on private property, the Landowner(s) may at any time, for any reason at their discretion, annul the right of passage which they are according me.

 

Furthermore I agree to comply with the following Terms of Responsible Use:

1               The Trails may NOT be used by motorized vehicles other than for emergency reasons.

2               The Trails may only be used for hiking, cross-country skiing, snowshoeing and bicycling (on designated trails only) and no other purpose, whether or not recreational. Access to Trails via the shoreline of Lake Manitou and vice versa is prohibited other than during winter months for cross-country skiing and snowshoeing.

3               Hunting, fishing and poaching are expressly prohibited on or from the Trails.

4               Fires, lighters, matches, explosives and other incendiary devices are expressly prohibited on the Trails.

5               Bicyclists should go slowly and give adequate, polite warning when approaching hikers when using Trails but agree that they may only use such Trails that have been specifically identified for biking use on the Trails Club Map.

6               The Trails Club Map is available upon request for Trails Club Members only. IT IS AGREED AND IT IS  OF THE UTMOST IMPORTANCE that the Trails Club Map is not uploaded to the internet or shared with the general public, and I agree that I will forfeit my membership and all of my rights thereunder in the event that I give copies (whether physical or digital) of the Trails Club Map to any non-members, other than members of my immediate family and my personal invitees, for whom I am responsible

7                I agree to stay on the Trails.

8               I agree that the Trails are single file only and to give warning when approaching a blind curve at speed.

9               I agree to respect private property and residents’ privacy.

10             I agree to leave the trail as clean as I found it and to carry out all litter and debris.

11             I agree not to uproot flowers or plants and to leave them for others to enjoy.

12             I agree to leave only my tracks and take nothing but photographs.

13             I agree to conduct branch-trimming only as required to maintain single file passage.

14             I understand that certain private properties on which there are Trails are held solely with a view to ecological preservation and other similar objects and I will respect those objects when passing on those Trails.

 

For greater certainty, I acknowledge and agree that the failure to abide by any of the foregoing Terms of Responsible Use may result in the immediate forfeiture of my membership in the Trails Club and all of my rights as a member.

 

Safety Precautions:

The Trails Club recommends that all members, users and guests take the following precautions to minimize risk when using the  trails:

1               If it is your first time using a trail, travel with a companion who is familiar with the trail.

2               Use the buddy system, and if you don’t have a buddy, check out and in with a neighbour.

3               Travel prepared--with water, a cell phone, energy snacks and proper clothing including a change of gloves in winter.

4               Ensure that winter lake ice conditions are safe.

5               DO NOT use trails during hunting seasons – use the following link for information regarding hunting seasons in the region: (http://www.mddefp.gouv.qc.ca/faune/reglementation­en/chasse/).

6               Not all trails are adequately marked (and even those that are marked are marked sporadically). Familiarize yourself with the route ahead of time or go with someone who knows the trail if you don’t know it yourself.

 

Membership - L’Association pour l’amélioration du Lac Manitou et de ses environs (AALM)

Whereas the AALM benefits every Trails Club member by paying for and maintaining liability insurance through the Union des municipalités, paying for trail signage, maintaining digital trail maps, and hosting Trails Club hospitality events, Trails Club members are requested to be in good standing as members of the AALM. I ACKNOWLEDGE AND AGREE that I have read and understood the Terms of Responsible Use and Safety Precautions set forth above and by signing below acknowledge and agree that I and any guest that I invite to use the trails will respect the terms and conditions of this Membership Agreement.
